Terms of Service for OutfitSnap

1. Agreement

These Terms of Service ("Terms") govern your use of the OutfitSnap mobile application and related services ("Service"). By downloading, accessing, or using OutfitSnap, you agree to these Terms.

If you do not agree, do not use the Service.

3. Eligibility

You may use the Service only if:

• You are at least 9 years old
• You can form a binding agreement under applicable law
• Your use is not prohibited by applicable law
• You provide accurate account information
• You are authorized to use any photos and content you upload

If you are under 18, you should use the Service only with parent or guardian permission where required by applicable law.

4. Accounts

To use key features, you may need an account. You are responsible for:

• Keeping login credentials secure
• All activity under your account
• Providing accurate information
• Promptly updating your profile if it changes

You may register with email/password or, where available, Sign in with Apple.

We may suspend or terminate access if we reasonably believe your account is being used unlawfully, abusively, or in violation of these Terms.

5. Guest and Free Access

Some parts of the app may be accessible without a full paid subscription or while not fully signed in. We may also offer limited free usage, including device-based free generation allowances. Free features, limits, and eligibility may change at any time.

6. User Content

"User Content" includes photos, wardrobe uploads, body photos, profile photos, prompts, saved outfit names, notes, and other content you submit.

You retain ownership of your User Content, but you grant OutfitSnap a limited, non-exclusive, worldwide license to host, store, reproduce, modify, process, transmit, and display that content only as needed to operate, secure, improve, and provide the Service to you.

You represent that:

• You own the content you upload or have permission to use it
• Your content does not violate law or third-party rights
• Your content does not include material you are prohibited from sharing

7. Prohibited Conduct

You may not:

• Use the Service for unlawful, fraudulent, abusive, or deceptive purposes
• Upload content that infringes intellectual property or privacy rights
• Upload sexual, exploitative, or otherwise illegal content
• Upload content involving minors in unlawful, exploitative, or sexualized contexts
• Attempt to reverse engineer, scrape, overload, disrupt, or bypass the Service
• Circumvent subscription, token, rate-limit, or free-usage controls
• Use generated results in a way that violates law or third-party rights

We may remove content, limit functionality, or suspend accounts for violations.

8. AI Features

OutfitSnap includes AI-powered features such as clothing categorization, outfit rendering, and image generation/editing. AI output can be imperfect. You understand and agree that:

• Results may be inaccurate, unrealistic, or unsatisfactory
• Output may depend on the quality of your uploaded images and prompts
• We do not guarantee that AI output will meet your expectations or be fit for any particular purpose
• You are responsible for how you use any AI-generated result

9. Subscriptions, Tokens, and Purchases

OutfitSnap may offer:

• Free plan access
• Paid subscriptions
• One-time token packages
• Promotional or restored entitlements

9.1 Billing

On iOS, paid purchases are processed through Apple. Apple controls billing, renewals, cancellations, and refunds under its own terms.

9.2 Auto-renewal

Subscriptions may automatically renew unless cancelled through your Apple account settings before renewal.

9.3 Tokens

Some features require tokens. Token grants may come from subscriptions, promotions, or one-time purchases.

Subscription-included tokens may expire at the end of the relevant billing cycle. Purchased token packages may be subject to the rules shown in the app, applicable law, and account status.

9.4 Changes

We may change available plans, token packages, feature limits, or entitlements prospectively.

10. Refunds

For App Store purchases, refunds are generally handled by Apple, not by OutfitSnap. If you seek a refund, you must follow Apple's refund process unless applicable law requires otherwise.

11. Account Deletion

You may delete your account from the app. Account deletion is intended to permanently remove your profile and related app data from our systems, subject to limited retention required for legal, accounting, anti-fraud, security, or technical reasons.

Deletion may be irreversible.

12. Intellectual Property

The Service, including the app, code, design, branding, text, graphics, software, and service structure, is owned by OutfitSnap or its licensors and is protected by intellectual property laws.

Except as expressly allowed in these Terms, you may not copy, distribute, modify, create derivative works from, sell, sublicense, or exploit the Service.

13. Third-Party Services

The Service relies on third-party providers, including Apple, Supabase, RevenueCat, Google AI services, and FASHN. We are not responsible for downtime, errors, policy changes, or business practices of third-party services.

14. Privacy

Your use of the Service is also governed by our Privacy Policy.

15. Service Availability

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, including features, plans, storage behavior, AI providers, or availability in specific countries.

We do not guarantee uninterrupted or error-free service.

16. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and availability.

17. Limitation of Liability

To the maximum extent permitted by law:

• OutfitSnap will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages
• OutfitSnap will not be liable for loss of data, profits, goodwill, or business interruption
• Our total liability for claims arising out of or relating to the Service will not exceed the greater of the amount you paid to OutfitSnap for the Service during the 12 months before the event giving rise to the claim, or the minimum amount required by applicable law

Nothing in these Terms limits liability that cannot lawfully be excluded.

18. Indemnity

You agree to defend, indemnify, and hold harmless OutfitSnap from claims, liabilities, damages, losses, and expenses arising out of:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of law or third-party rights

19. Termination

We may suspend or terminate your access at any time if we reasonably believe:

• You violated these Terms
• Your use creates legal or security risk
• We are required to do so by law
• The Service can no longer reasonably be provided

Sections that by their nature should survive termination will survive, including sections on ownership, disclaimers, limitations of liability, indemnity, and dispute-related provisions.

20. Governing Law

These Terms are governed by the laws of Poland, without regard to conflict-of-law principles, except where mandatory consumer protection law in your place of residence applies and cannot be waived.

21. Disputes

If you have a dispute or complaint, contact outfitsnap.app@gmail.com first and we will try to resolve it informally.

If a dispute cannot be resolved informally, it will be handled in the courts having jurisdiction under applicable law, subject to any mandatory consumer rights.

22. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by a new "Last Updated" date. If you continue using the Service after the updated Terms take effect, you agree to the updated Terms, to the extent permitted by law.

23. Miscellaneous

• These Terms and the Privacy Policy form the entire agreement between you and OutfitSnap regarding the Service.
• If any provision is found unenforceable, the remaining provisions remain in effect.
• Our failure to enforce any provision is not a waiver.
• You may not assign your rights or obligations under these Terms without our consent. We may assign ours as part of a business transfer or reorganization.
